5‑Year Replacement Shipping Service Agreement

This 5‑Year Replacement Shipping Service Agreement (“Agreement”) describes the logistics services provided for eligible power stations and solar generators located in Puerto Rico, Alaska, Hawaii, U.S. Virgin Islands, and Guam (“Service Region”).

By accepting this Agreement, you acknowledge and agree to the terms below.

1. Service Description

The Replacement Shipping Service is a logistics coordination service for certified shipping of eligible power stations or solar generators when a manufacturer has approved a warranty replacement.

This service covers the movement of your unit between your Service Region, our designated mainland freight forwarder, and the manufacturer’s designated location, as applicable.

2. What This Service Includes

  • Coordination of shipping from your Service Region to our designated mainland freight forwarder.
  • Coordination of certified dangerous‑goods shipping, where required by law or carrier rules.
  • Coordination of the replacement unit shipment from the manufacturer back to your Service Region.
  • Communication with you regarding shipping status, instructions, and hub details.

3. What This Service Does Not Include

  • Warranty approval or denial of any product. All warranty decisions are made solely by the manufacturer.
  • Product repair, diagnosis, or technical support for your power station or solar generator.
  • Any product warranty coverage of any kind.
  • Door pickup or door delivery services (these may be offered separately, if available, at additional cost).
  • Coverage for loss or damage outside the scope of carrier and freight forwarder terms.

4. Eligibility and Service Term

  • This Agreement applies only to the specific unit and tier (Small, Medium, or Large) associated with your purchase.
  • The service term is 5 years from the original purchase date of the Replacement Shipping Service.
  • The unit must be located within the Service Region at the time of any claim‑related shipment.
  • If your unit is replaced or upgraded by the manufacturer, this Agreement continues to apply only to the replacement unit within the same tier, unless otherwise agreed in writing.

5. Your Responsibilities

  • Obtain and maintain a valid, manufacturer‑approved warranty claim, including an RMA number and any required return label.
  • Provide us with accurate and complete information, including:
    • Your contact details.
    • Your Service Region location.
    • A copy of the manufacturer’s RMA and any shipping label or instructions.
  • Prepare and package your unit safely and in accordance with all instructions we provide.
  • Deliver your unit to the designated hub or drop‑off location, unless you separately purchase door pickup (if available).
  • Pick up your replacement unit from the designated hub or delivery point, unless you separately purchase door delivery (if available).

6. Dangerous‑Goods and Compliance

  • Many power stations and solar generators are classified as dangerous goods for shipping purposes.
  • We will coordinate shipping using carriers and freight forwarders that follow applicable dangerous‑goods regulations and carrier rules.
  • You agree to follow all packaging, labeling, and handling instructions we provide. Failure to follow these instructions may result in delays, additional costs, or refusal of shipment.
  • If a carrier or freight forwarder refuses the shipment due to non‑compliance with instructions, you are responsible for correcting the issue before shipment can proceed.

7. Limitations of Service

  • Service timelines are estimates and depend on carriers, freight forwarders, customs, weather, and other factors outside our control.
  • We are not responsible for delays, loss, or damage caused by carriers, freight forwarders, customs authorities, or other third parties, except to the extent recoverable under their standard terms.
  • We may temporarily suspend or modify service if required by changes in law, carrier rules, or dangerous‑goods regulations.

8. Fees and Pricing

  • The fee for this service was paid at the time of your product listing purchase (Small, Medium, or Large tier).
  • This Agreement does not modify the price you paid and does not add any new charges without your prior consent.
  • Optional services such as door pickup or door delivery, if offered, may require additional payment at the time they are requested.

9. Termination

  • You may request cancellation of this Agreement in writing. Refund eligibility, if any, will follow the refund policy in effect at the time of your purchase.
  • We may terminate this Agreement if:
    • You provide false or misleading information.
    • You misuse the service or attempt to use it for ineligible products or locations.
    • Changes in law or carrier rules make the service impractical or impossible to perform.
  • Upon termination, no further logistics services will be provided under this Agreement, except as required by law.

10. Governing Law

This Agreement is governed by the laws of the State of Florida, without regard to its conflict‑of‑law principles, unless otherwise required by applicable consumer protection laws.

  • You understand that all warranty approvals are made solely by the manufacturer.
  • You agree to the responsibilities and limitations described above.
